General Terms and Conditions (GTC) for IT SVP in Switzerland

  1. Scope
    These GTC apply to all business relationships between IT SVP (Simtek GmbH) and customers in Switzerland. Deviating terms and conditions of the customer are not recognized.
  2. Conclusion of Contract
    Offers are non-binding. The contract is only concluded upon express confirmation by IT SVP / Simtek GmbH.
  3. Prices & Payment Terms
    Prices in CHF, including statutory VAT. Payment within 30 days net without deductions.
  4. Delivery & Shipping
    Delivery times are non-binding unless otherwise agreed. Partial deliveries are permitted.
  5. Retention of Title
    Goods remain property of IT SVP/Simtek GmbH until full payment is made.
  6. Warranty & Returns
    Warranty according to the Swiss Code of Obligations. No right of return for custom-made products.
  7. Limitation of Liability
    Liability only for willful intent and gross negligence.
  8. Data Protection
    Personal data is processed according to Swiss Data Protection Act.
  9. Place of Jurisdiction & Applicable Law
    Jurisdiction: Higher Court of the Canton of Zug. Swiss law applies.
  10. Severability Clause
    If any provision is invalid, the rest remains effective.
